Welcome to Blinkcook.com. By registering, making payment, accessing our website, or using our services, you agree to comply with and be bound by the following Terms & Conditions.

Blinkcook is a domestic staffing sourcing and matching assistance platform connecting customers with cooks, maids, babysitters, caretakers, home nurses, and related household staff.


  1. Introduction

Welcome to Blinkcook (“Blinkcook“, “we“, “our“, or “us“).

Blinkcook is an online platform that provides sourcing and matching assistance to help Customers connect with prospective Cooks and Maids for household employment requirements. Blinkcook assists Customers by sourcing suitable Candidates, conducting preliminary screening, facilitating Customer-Candidate introductions, coordinating interviews or trials (where applicable), and providing operational support during the subscribed service period.

These Terms & Conditions (“Terms“) govern your access to and use of Blinkcook’s website, customer support channels, communication platforms, and all services offered by Blinkcook.

These Terms constitute a legally binding agreement between Blinkcook and every Customer who accesses or uses our services.

By visiting Blinkcook, submitting a service requirement, making any payment, communicating with Blinkcook, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Refund Policy, Privacy Policy, and any other policies published by Blinkcook.

If you do not agree with these Terms, you must immediately discontinue the use of Blinkcook’s services.

  1. Definitions

Unless the context otherwise requires, the following terms shall have the meanings assigned below.

2.1 Blinkcook

“Blinkcook” refers to Blinkcook.com, its proprietors, directors, employees, Relationship Managers (RMs), representatives, affiliates, contractors, authorized personnel, successors, and assigns providing Cook and Maid sourcing and matching assistance services.

2.2 Customer

A “Customer” means any individual, family, company, organization, institution, partnership, trust, or other legal entity that registers with Blinkcook or purchases any service for the purpose of hiring a Cook or Maid.

2.3 Candidate

A “Candidate” means an individual who registers with Blinkcook or whose profile is sourced by Blinkcook for potential household employment as a:

  • Cook; or
  • Maid.

2.4 Services

“Services” mean the sourcing and matching assistance provided by Blinkcook for Cook and Maid hiring, including but not limited to:

  • collecting Customer requirements;
  • Candidate sourcing;
  • preliminary screening;
  • Customer-Candidate introductions;
  • interview coordination;
  • trial coordination, where applicable;
  • operational follow-up;
  • customer support; and
  • other related operational activities under the subscribed service plan.

Blinkcook provides sourcing and matching assistance only and does not provide employment, manpower supply, recruitment guarantees, or staffing guarantees.

2.5 Relationship Manager (RM)

A “Relationship Manager” or “RM” means an authorized Blinkcook representative responsible for coordinating the Customer’s service request, sourcing Candidates, facilitating Customer-Candidate communication, coordinating interviews or trials where applicable, and performing operational activities relating to the subscribed service.

Blinkcook may assign, replace, or reassign an RM at any stage of the service process based on operational requirements.

2.6 Operational Activities

“Operational Activities” include all reasonable activities undertaken by Blinkcook for providing the subscribed service, including but not limited to:

  • requirement verification;
  • requirement processing;
  • RM allocation;
  • Candidate sourcing;
  • Candidate outreach;
  • preliminary screening;
  • profile evaluation;
  • Customer-Candidate coordination;
  • interview scheduling;
  • trial coordination;
  • follow-up communication;
  • verification activities;
  • customer support; and
  • any other operational activity reasonably necessary for fulfilling the subscribed service.

2.7 Service Commencement

“Service Commencement” occurs immediately upon Blinkcook initiating any Operational Activity in connection with the Customer’s confirmed service requirement.

Service Commencement does not depend upon Candidate selection, interview completion, trial completion, joining, or successful employment.

2.8 Suitable Candidate

A “Suitable Candidate” means a Candidate who substantially matches the Customer’s confirmed requirements after considering factors including:

  • Cook or Maid category;
  • work location;
  • salary expectations;
  • working hours;
  • number of visits;
  • accommodation requirements, where applicable;
  • work responsibilities;
  • Candidate willingness;
  • Candidate availability; and
  • prevailing market conditions.

2.9 Customer-Candidate Introduction

A “Customer-Candidate Introduction” means any communication or interaction facilitated by Blinkcook between a Customer and a Candidate.

Such introduction may occur through:

  • sharing Candidate details with the Customer;
  • sharing Customer details with the Candidate;
  • arranging telephone conversations;
  • facilitating WhatsApp communication;
  • coordinating interviews or trials; or
  • any other operationally appropriate method.

A Candidate contacting the Customer following Blinkcook’s sourcing and coordination activities shall also constitute a valid Customer-Candidate Introduction.

2.10 Operational Records

“Operational Records” include records generated during the service process, including but not limited to:

  • call records;
  • WhatsApp communications;
  • emails;
  • Customer communications;
  • Candidate communications;
  • payment records;
  • interview records;
  • trial records;
  • internal notes;
  • service history; and
  • other operational documentation.

Blinkcook may maintain and use Operational Records for customer support, quality assurance, fraud prevention, dispute resolution, internal audits, and compliance with applicable law.

  1. Acceptance of Terms

By using Blinkcook’s services, the Customer represents and warrants that they:

  • have read and understood these Terms;
  • agree to comply with these Terms;
  • agree to Blinkcook’s Refund Policy and Privacy Policy;
  • have the legal capacity to enter into a binding agreement;
  • will provide accurate and complete information; and
  • will use Blinkcook’s services only for lawful purposes.

Acceptance of these Terms occurs immediately upon:

  • visiting Blinkcook’s website;
  • submitting a hiring requirement;
  • communicating with Blinkcook regarding a service request;
  • making a payment; or
  • using any Blinkcook service.
  1. Eligibility

To use Blinkcook’s services, a Customer must:

  • be at least 18 years of age;
  • have the legal capacity to enter into a binding contract under applicable law;
  • provide accurate and complete information;
  • comply with these Terms and all applicable laws; and
  • use the services only for lawful household hiring purposes.

Blinkcook reserves the right to refuse, suspend, or terminate access to its services if these eligibility requirements are not met.

  1. Nature of Blinkcook Services

Blinkcook operates solely as a Cook and Maid sourcing and matching assistance platform.

Blinkcook assists Customers by:

  • understanding hiring requirements;
  • sourcing prospective Cook and Maid Candidates;
  • conducting preliminary profile screening;
  • facilitating Customer-Candidate Introductions;
  • coordinating interviews or trials, where applicable; and
  • providing operational support during the active service period.

Blinkcook does not:

  • employ Candidates;
  • supervise Candidates after hiring;
  • guarantee Candidate availability;
  • guarantee Candidate acceptance of employment;
  • guarantee Candidate joining;
  • guarantee Candidate retention;
  • guarantee Candidate performance;
  • guarantee uninterrupted service; or
  • become a party to the employment relationship between the Customer and the Candidate.

All decisions relating to hiring, salary, work schedules, duties, accommodation, trial, joining, continuation of employment, suspension, resignation, or termination shall remain solely between the Customer and the Candidate.

  1. Customer Registration

Customers may be required to provide personal information to access Blinkcook’s services.

The Customer agrees to:

  • provide true, accurate, and complete information;
  • promptly update any changes to their information;
  • maintain the confidentiality of any account credentials;
  • notify Blinkcook of any unauthorized use of their account; and
  • cooperate with any reasonable verification requests.

Blinkcook reserves the right to verify Customer information before or during the service process.

  1. Customer Responsibilities

The Customer agrees to:

  • provide complete and accurate Cook or Maid hiring requirements;
  • clearly disclose work responsibilities, working hours, number of visits, accommodation requirements (if applicable), work location, and salary expectations before sourcing begins;
  • cooperate with Blinkcook throughout the service process;
  • communicate respectfully with Blinkcook personnel and Candidates;
  • attend scheduled interviews or trial discussions where applicable;
  • promptly communicate hiring decisions;
  • comply with applicable laws; and
  • comply with these Terms, the Refund Policy, and the Privacy Policy.

Failure to comply with these responsibilities may affect Blinkcook’s ability to provide the subscribed service and may result in suspension, termination of services, or other actions permitted under these Terms.

  1. Service Activation

The subscribed service shall be activated after:

  • successful payment confirmation;
  • confirmation of the Customer’s hiring requirement;
  • verification of essential service details, where applicable; and
  • commencement of Blinkcook’s operational process.

Service activation shall be deemed complete immediately upon Blinkcook initiating any Operational Activity relating to the Customer’s confirmed hiring requirement.

The Customer acknowledges that Blinkcook may begin operational work immediately after service activation.

  1. Service Validity

Unless otherwise specified under the subscribed service plan, Blinkcook shall provide Cook and Maid sourcing and matching assistance during the applicable Service Validity period.

The standard service validity shall ordinarily be 7 to 21 working days from the date of service activation.

Service Validity may vary depending on factors including:

  • Candidate availability;
  • locality;
  • salary expectations;
  • work schedule;
  • accommodation requirements;
  • market demand; and
  • operational feasibility.

Service Validity shall not automatically restart or extend merely because:

  • the Customer changes the hiring requirement;
  • Suitable Candidates are rejected;
  • a Candidate withdraws;
  • salary expectations change;
  • market conditions change; or
  • the Customer delays communication or decision-making.

Any extension of Service Validity shall be entirely at Blinkcook’s discretion or as expressly stated in the subscribed service plan.

  1. Relationship Manager (RM)

Following service activation, Blinkcook may assign a Relationship Manager (“RM”) or another authorized representative to coordinate the Customer’s service request.

The RM may assist with:

  • understanding hiring requirements;
  • Candidate sourcing;
  • preliminary screening;
  • Customer-Candidate coordination;
  • interview scheduling;
  • trial coordination;
  • follow-up communication; and
  • operational assistance throughout the active service period.

The allocation, replacement, reassignment, or withdrawal of an RM shall be an internal operational decision of Blinkcook and shall not affect the validity of the subscribed service.

The Customer acknowledges that multiple Blinkcook representatives may communicate during different stages of the service process.

  1. Candidate Sourcing Process

Blinkcook shall make reasonable efforts to source Candidates that substantially match the Customer’s confirmed hiring requirements.

The sourcing process may include:

  • reviewing available Candidate profiles;
  • contacting prospective Candidates;
  • discussing employment opportunities;
  • evaluating Candidate willingness;
  • conducting preliminary screening;
  • assessing availability;
  • verifying work preferences where reasonably practicable;
  • coordinating with interested Candidates; and
  • facilitating Customer-Candidate Introductions.

Candidate sourcing depends upon various operational factors, including:

  • locality;
  • salary expectations;
  • work timing;
  • accommodation requirements;
  • workload;
  • number of daily visits;
  • transportation;
  • Candidate availability; and
  • prevailing market conditions.

Accordingly, Blinkcook cannot guarantee immediate Candidate availability or successful placement.

  1. Customer-Candidate Introductions

Blinkcook may facilitate introductions using one or more operational methods, including:

  • sharing Candidate details with the Customer;
  • sharing Customer details with the Candidate;
  • arranging telephone conversations;
  • facilitating WhatsApp communication;
  • coordinating interviews;
  • coordinating trial discussions; or
  • any other communication method considered operationally appropriate.

Blinkcook shall determine the most suitable communication process for each service request.

A Customer-Candidate Introduction shall be deemed completed once Blinkcook has successfully facilitated communication between the Customer and a Candidate through any of the above methods.

  1. Candidate Shortlisting

Blinkcook may shortlist one or more Candidates based upon:

  • the Customer’s confirmed requirement;
  • operational feasibility;
  • Candidate availability;
  • Candidate willingness;
  • salary compatibility; and
  • prevailing market conditions.

The number of shortlisted Candidates may differ from one service request to another.

Blinkcook does not guarantee:

  • any minimum number of Candidate profiles;
  • any fixed number of interviews;
  • any fixed number of trials;
  • Candidate acceptance of employment;
  • Candidate joining; or
  • long-term Candidate retention.

Candidate availability may change at any time before joining due to circumstances beyond Blinkcook’s reasonable control.

  1. Interviews & Trial Coordination

Where operationally appropriate, Blinkcook may assist in coordinating interviews or trial discussions between the Customer and prospective Candidates.

The scheduling of interviews or trials shall depend upon:

  • Customer availability;
  • Candidate availability;
  • mutual agreement; and
  • operational feasibility.

Blinkcook coordinates such interactions solely to facilitate communication.

Blinkcook is not responsible for:

  • cancellation by either party;
  • rescheduling;
  • Candidate non-attendance;
  • Customer non-attendance;
  • disagreement during interviews;
  • failure to reach employment terms; or
  • decisions taken independently by either party.
  1. Hiring Decision

The final hiring decision shall always remain solely with the Customer.

Similarly, every Candidate shall remain free to:

  • accept employment;
  • decline employment;
  • negotiate salary;
  • negotiate work conditions;
  • withdraw from the hiring process; or
  • discontinue discussions before joining.

Blinkcook shall not influence or compel either party to enter into an employment relationship.

  1. Service Completion

The subscribed service shall generally be considered completed upon the occurrence of any one or more of the following events:

  • Blinkcook successfully facilitates one or more Customer-Candidate Introductions;
  • the Customer hires a Candidate introduced through Blinkcook;
  • the Customer independently decides not to continue the hiring process;
  • the active Service Validity period expires and Blinkcook completes its sourcing obligations in accordance with the subscribed service plan;
  • the service is otherwise concluded in accordance with these Terms and the Refund Policy.

Completion of Blinkcook’s sourcing obligations shall not depend upon:

  • successful employment;
  • Candidate retention;
  • duration of employment;
  • future disputes between the Customer and Candidate; or
  • continuation of employment after joining.
  1. Changes to Hiring Requirements

Customers should provide complete and accurate hiring requirements before Blinkcook commences Candidate sourcing.

If the Customer materially changes the confirmed requirement after Service Commencement, including changes relating to:

  • salary;
  • locality;
  • work schedule;
  • number of visits;
  • work responsibilities;
  • accommodation requirements;
  • employment category (Cook or Maid); or
  • any other significant condition,

Blinkcook may:

  • reassess operational feasibility;
  • modify its sourcing strategy;
  • recommend revised salary expectations;
  • extend sourcing timelines where appropriate;
  • continue sourcing under the revised requirement; or
  • determine that previously shortlisted Candidates are no longer suitable.

Such changes may also affect refund eligibility as set out in the Refund Policy.

  1. Customer Cooperation

The Customer agrees to cooperate throughout the service process by:

  • responding to Blinkcook communications within a reasonable time;
  • attending scheduled interviews or trial discussions where applicable;
  • providing timely hiring decisions;
  • informing Blinkcook if a Candidate is selected or rejected;
  • communicating requirement changes promptly; and
  • maintaining respectful communication with Blinkcook representatives and Candidates.

Failure to reasonably cooperate may affect Blinkcook’s ability to provide the subscribed service and may impact service timelines or refund eligibility in accordance with the Refund Policy.

  1. Service Fees & Payment

Customers shall pay the applicable service fee specified by Blinkcook at the time of booking.

The service fee is charged for the operational services provided by Blinkcook, including but not limited to:

  • understanding Customer requirements;
  • processing service requests;
  • assigning a Relationship Manager (RM);
  • Candidate sourcing;
  • Candidate outreach;
  • preliminary screening;
  • Customer-Candidate Introductions;
  • interview or trial coordination (where applicable);
  • customer support; and
  • other operational activities necessary to provide the subscribed service.

The service fee is not a salary payment to any Candidate and does not form part of the Candidate’s wages or employment compensation.

  1. Payment Terms

Customers agree that:

  • all payments shall be made through Blinkcook’s approved payment methods;
  • payment confirmation may be required before service activation;
  • applicable taxes, if any, shall be payable in accordance with law;
  • payment details must be accurate and complete; and
  • Blinkcook reserves the right to refuse service where payment cannot be successfully processed.

A booking shall not be considered confirmed until Blinkcook receives successful payment confirmation.

  1. Refund Policy

Refunds shall be governed exclusively by Blinkcook’s Refund Policy, which forms an integral part of these Terms & Conditions.

By using Blinkcook’s services, the Customer confirms that they have read, understood, and accepted the Refund Policy.

Where any provision of these Terms relates to refunds, it shall be interpreted together with the Refund Policy.

  1. Customer Obligations

The Customer agrees to:

  • provide complete and accurate hiring requirements before service activation;
  • provide realistic salary expectations based on prevailing market conditions;
  • disclose all work responsibilities before Candidate sourcing begins;
  • provide accurate work location details;
  • disclose accommodation requirements, if applicable;
  • communicate honestly with Blinkcook;
  • cooperate throughout the sourcing process;
  • attend scheduled interviews or trial discussions where applicable;
  • promptly communicate hiring decisions; and
  • comply with all applicable laws.

The Customer further agrees not to intentionally delay, obstruct, or interfere with Blinkcook’s operational activities.

  1. Customer Conduct

Customers shall maintain respectful and professional conduct while interacting with:

  • Blinkcook employees;
  • Relationship Managers;
  • Customer Support representatives; and
  • Candidates.

The Customer shall not:

  • use abusive language;
  • threaten Blinkcook personnel;
  • harass Candidates;
  • discriminate unlawfully;
  • intimidate employees;
  • submit false complaints;
  • misuse communication channels; or
  • engage in any unlawful conduct.

Blinkcook reserves the right to suspend or terminate services where such conduct materially affects its operations or the safety of its personnel.

  1. Communication Policy

Blinkcook shall determine the communication process most appropriate for each booking.

Communication may occur through:

  • Relationship Managers;
  • authorized representatives;
  • Customer Support;
  • telephone;
  • WhatsApp;
  • email; or
  • other official communication channels designated by Blinkcook.

Blinkcook may also facilitate direct communication between the Customer and the Candidate whenever operationally appropriate.

Accordingly, the Customer acknowledges that:

  • communication methods may differ between bookings;
  • different Blinkcook representatives may communicate during the service process;
  • Candidates may contact Customers following Blinkcook’s coordination; and
  • the absence of communication from any specific employee shall not, by itself, indicate that Blinkcook has failed to perform the subscribed service.

Only communication through Blinkcook’s officially designated channels shall be treated as official communication.

  1. Fair Usage Policy

Blinkcook’s services are intended for genuine household hiring requirements.

Customers are expected to evaluate Candidates reasonably and in good faith based on the confirmed hiring requirement.

Repeated rejection of Suitable Candidates solely due to:

  • changing personal preferences;
  • repeated salary revisions;
  • repeated locality changes;
  • repeated work requirement changes;
  • unrealistic expectations; or
  • reasons inconsistent with the originally confirmed requirement,

may adversely affect Blinkcook’s ability to continue sourcing effectively.

Nothing in this section prevents a Customer from rejecting a Candidate for genuine concerns relating to suitability, work experience, compatibility, or safety.

  1. Customer-Candidate Relationship

Following a successful hiring, the employment relationship shall exist solely between the Customer and the Candidate.

Blinkcook shall not be responsible for:

  • salary negotiations;
  • work schedules;
  • leave policies;
  • accommodation arrangements;
  • performance evaluation;
  • disciplinary actions;
  • resignation;
  • termination; or
  • any other employment-related matter.

Customers are encouraged to clearly discuss employment terms directly with the Candidate before finalizing employment.

  1. Anti-Circumvention

Customers acknowledge that Blinkcook invests significant operational resources in sourcing and coordinating Candidates.

Accordingly, Customers shall not intentionally attempt to circumvent Blinkcook’s service process by:

  • encouraging Candidates to bypass Blinkcook during the active Service Validity period;
  • providing misleading information to avoid applicable service fees;
  • misrepresenting hiring outcomes; or
  • engaging in any conduct intended to deprive Blinkcook of the benefit of its operational services.

Blinkcook reserves the right to take appropriate action where fraudulent or deceptive conduct is identified, including suspension of services or pursuit of remedies available under applicable law.

Nothing in this clause shall restrict any rights that cannot lawfully be limited under applicable law.

  1. Service Suspension or Cancellation

Blinkcook reserves the right to suspend, restrict, or terminate its services where:

  • the Customer provides false or misleading information;
  • payment is unsuccessful or reversed;
  • the Customer repeatedly abuses Blinkcook personnel;
  • fraudulent activity is reasonably suspected;
  • the Customer uses the service for unlawful purposes;
  • the Customer materially breaches these Terms;
  • continued service becomes operationally impracticable; or
  • suspension is reasonably necessary to comply with applicable law.

Where appropriate, Blinkcook may notify the Customer before taking such action, unless immediate action is reasonably necessary.

Suspension or termination under this section shall not automatically entitle the Customer to a refund, which shall instead be determined in accordance with the Refund Policy.

  1. Customer Feedback & Complaints

Blinkcook values Customer feedback and aims to resolve concerns fairly and efficiently.

Customers may submit complaints or feedback through Blinkcook’s official communication channels.

To assist in resolving a complaint, Customers should provide:

  • booking details;
  • a clear description of the issue;
  • relevant dates;
  • supporting documents or communications, where available; and
  • any other information reasonably requested by Blinkcook.

Blinkcook will review complaints in good faith and may rely on Operational Records, Customer communications, Candidate communications, and other relevant information while investigating the matter.

Submission of a complaint does not automatically establish fault or create an entitlement to compensation or refund.

  1. Intellectual Property Rights

Unless otherwise stated, all intellectual property rights relating to Blinkcook are owned by or licensed to Blinkcook.

These rights include, but are not limited to:

  • Blinkcook name;
  • logo;
  • trademarks;
  • website design;
  • software;
  • source code;
  • databases;
  • graphics;
  • icons;
  • images;
  • text;
  • service descriptions;
  • business processes;
  • documentation;
  • marketing materials; and
  • all other proprietary content made available through Blinkcook.

Customers are granted a limited, non-exclusive, non-transferable, and revocable right to access and use Blinkcook solely for lawful personal household hiring purposes.

Customers shall not, without Blinkcook’s prior written consent:

  • copy;
  • reproduce;
  • modify;
  • distribute;
  • publish;
  • license;
  • sell;
  • reverse engineer;
  • decompile;
  • extract data from; or
  • commercially exploit any part of Blinkcook or its content.

Nothing contained in these Terms transfers any intellectual property rights from Blinkcook to the Customer.

  1. Platform Role

Blinkcook operates solely as a Cook and Maid sourcing and matching assistance platform.

Blinkcook’s responsibilities are limited to:

  • understanding Customer hiring requirements;
  • sourcing prospective Candidates;
  • conducting preliminary screening;
  • facilitating Customer-Candidate Introductions;
  • coordinating interviews or trials where applicable; and
  • providing operational support during the subscribed service period.

Blinkcook is not:

  • the employer of any Candidate;
  • the legal representative of any Customer or Candidate;
  • an employment agency guaranteeing placement;
  • a manpower supplier;
  • a staffing contractor;
  • a payroll provider; or
  • a guarantor of Candidate performance or continued employment.

The employment relationship, if any, exists solely between the Customer and the Candidate.

All decisions regarding:

  • hiring;
  • salary;
  • working hours;
  • leave;
  • accommodation;
  • job responsibilities;
  • supervision;
  • disciplinary action;
  • resignation; and
  • termination

shall remain solely between the Customer and the Candidate.

  1. Disclaimer of Warranties

Blinkcook provides its services on a best-effort basis.

While Blinkcook endeavors to source Suitable Candidates, the Customer acknowledges that Candidate availability depends on numerous factors beyond Blinkcook’s reasonable control.

Accordingly, Blinkcook does not warrant or guarantee:

  • uninterrupted service;
  • continuous Candidate availability;
  • successful placement;
  • Candidate acceptance of employment;
  • Candidate joining;
  • Candidate retention;
  • Candidate performance;
  • compatibility between Customer and Candidate;
  • accuracy of information provided by Candidates beyond reasonable verification; or
  • any specific employment outcome.

All services are provided “as available” and “as applicable”, subject to operational feasibility and prevailing market conditions.

Nothing in this section limits any statutory rights that cannot lawfully be excluded under applicable law.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, Blinkcook shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to:

  • Candidate refusal to accept employment;
  • Candidate resignation;
  • Candidate absenteeism;
  • Candidate misconduct;
  • Candidate theft;
  • Candidate negligence;
  • poor work performance;
  • Customer dissatisfaction;
  • salary disputes;
  • working condition disputes;
  • accommodation disputes;
  • misunderstandings between the Customer and Candidate;
  • employment termination;
  • independent negotiations between Customers and Candidates;
  • delays caused by either party;
  • third-party actions; or
  • events beyond Blinkcook’s reasonable control.

Blinkcook’s role is limited to facilitating sourcing and introductions.

Blinkcook shall not be responsible for supervising Candidates after employment begins.

To the extent permitted by law, Blinkcook’s aggregate liability arising from any claim relating to its services shall not exceed the amount actually paid by the Customer as the applicable service fee.

Nothing contained in these Terms excludes liability that cannot legally be excluded under applicable law.

  1. Customer Indemnity

The Customer agrees to indemnify, defend, and hold harmless Blinkcook, its proprietors, employees, Relationship Managers, representatives, affiliates, and authorized personnel from and against any claims, demands, actions, proceedings, liabilities, losses, damages, costs, or expenses (including reasonable legal expenses) arising from or relating to:

  • breach of these Terms;
  • violation of applicable law;
  • false or misleading information provided by the Customer;
  • misuse of Blinkcook’s services;
  • unlawful conduct;
  • disputes arising directly between the Customer and the Candidate after introduction; or
  • infringement of the rights of any third party by the Customer.

This indemnity shall apply only to the extent permitted by applicable law.

  1. Force Majeure

Blinkcook shall not be responsible for any delay, interruption, suspension, or inability to perform its services where such delay or failure results from circumstances beyond its reasonable control.

Such circumstances may include, but are not limited to:

  • natural disasters;
  • floods;
  • earthquakes;
  • pandemics;
  • epidemics;
  • government restrictions;
  • strikes;
  • labour shortages;
  • civil unrest;
  • war;
  • internet outages;
  • telecommunications failures;
  • power failures;
  • cyber-attacks;
  • system failures; or
  • any other event beyond Blinkcook’s reasonable control.

Where reasonably practicable, Blinkcook shall resume services after the relevant circumstances cease.

  1. Operational Records

Blinkcook maintains Operational Records for legitimate business purposes, including:

  • service administration;
  • quality assurance;
  • customer support;
  • Candidate coordination;
  • fraud prevention;
  • dispute resolution;
  • compliance with applicable law; and
  • internal operational review.

Operational Records may include:

  • telephone call records;
  • WhatsApp communications;
  • emails;
  • payment history;
  • Customer communications;
  • Candidate communications;
  • interview records;
  • trial records;
  • Customer support records;
  • internal notes; and
  • other documentation generated during the service process.

Blinkcook may rely upon such Operational Records while investigating complaints, reviewing refund requests, responding to legal requirements, or resolving disputes, subject to applicable law.

  1. Verification & Background Information

Blinkcook may conduct reasonable preliminary verification of Candidate information where operationally practicable.

However, unless expressly stated in writing, Blinkcook does not warrant or guarantee the completeness, accuracy, or ongoing validity of any information provided by Candidates.

Customers are encouraged to independently verify any information they consider important before offering employment, including:

  • identity;
  • address;
  • previous employment history;
  • references;
  • police verification (where desired);
  • medical fitness (if applicable); and
  • any other information relevant to the Customer’s hiring decision.

The final responsibility for hiring decisions rests solely with the Customer.

  1. Suspension or Termination of Customer Access

Blinkcook reserves the right to suspend, restrict, or permanently terminate access to its services where the Customer:

  • materially breaches these Terms;
  • provides false or misleading information;
  • engages in fraudulent activity;
  • abuses Blinkcook personnel;
  • repeatedly disrupts operational activities;
  • attempts to misuse the platform;
  • uses the services for unlawful purposes; or
  • otherwise engages in conduct that materially affects Blinkcook’s operations.

Where reasonably practicable, Blinkcook may provide prior notice before suspension or termination.

Suspension or termination under this section shall not automatically create any entitlement to a refund, which shall instead be determined in accordance with the Refund Policy.

  1. Privacy & Data Protection

Blinkcook respects the privacy of its Customers and Candidates and is committed to handling personal information responsibly.

The collection, use, storage, processing, sharing, and protection of personal information shall be governed by Blinkcook’s Privacy Policy, which forms an integral part of these Terms.

By using Blinkcook’s services, the Customer consents to Blinkcook collecting, processing, storing, and using information reasonably necessary for:

  • service registration;
  • account administration;
  • Candidate sourcing;
  • Customer-Candidate coordination;
  • interview and trial coordination;
  • customer support;
  • payment processing;
  • fraud prevention;
  • dispute resolution;
  • legal compliance; and
  • improving Blinkcook’s services.

Blinkcook shall take reasonable administrative, technical, and organizational measures to safeguard personal information. However, no method of electronic transmission or storage is completely secure, and Blinkcook cannot guarantee absolute security.

  1. Electronic Communications

The Customer agrees that Blinkcook may communicate electronically regarding the subscribed services.

Official communications may be sent through:

  • Email;
  • Telephone;
  • SMS;
  • WhatsApp;
  • Blinkcook’s website;
  • Customer Support; or
  • any other communication method designated by Blinkcook.

Electronic communications from Blinkcook shall be considered valid and legally effective to the extent permitted under applicable law.

Customers are responsible for ensuring that their contact information remains accurate and up to date.

Blinkcook shall not be responsible for delays or failures in communication caused by:

  • incorrect contact information;
  • network failures;
  • email filtering;
  • blocked numbers;
  • device issues; or
  • circumstances beyond Blinkcook’s reasonable control.
  1. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute, controversy, or claim arising out of or relating to:

  • these Terms;
  • Blinkcook’s services;
  • the Refund Policy;
  • the Privacy Policy; or
  • any transaction between Blinkcook and the Customer,

shall be subject to the exclusive jurisdiction of the competent courts located in Guwahati, Assam, India, unless otherwise required by applicable law.

Before initiating legal proceedings, the parties are encouraged to make reasonable efforts to resolve disputes through good-faith communication.

  1. Amendments to the Terms

Blinkcook reserves the right to modify, update, revise, replace, or amend these Terms from time to time to reflect:

  • operational changes;
  • legal developments;
  • regulatory requirements;
  • technological improvements;
  • business practices; or
  • service enhancements.

Updated Terms shall become effective upon publication on Blinkcook’s website or on such later date as may be specified.

Customers are encouraged to review these Terms periodically.

Continued use of Blinkcook’s services after the publication of updated Terms shall constitute acceptance of the revised Terms.

  1. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall, to the extent necessary, be deemed severed from these Terms.

The remaining provisions shall continue in full force and effect to the fullest extent permitted by applicable law.

  1. Waiver

Failure by Blinkcook to enforce any provision of these Terms on any occasion shall not constitute a waiver of its right to enforce that provision or any other provision at a later time.

Any waiver by Blinkcook shall be effective only if made expressly in writing by an authorized representative.

  1. Entire Agreement

These Terms, together with the following documents, constitute the entire agreement between Blinkcook and the Customer regarding the use of Blinkcook’s services:

  • Refund Policy;
  • Privacy Policy;
  • Service Plan (where applicable);
  • Payment Confirmation; and
  • any written communication expressly designated by Blinkcook as forming part of the agreement.

These documents supersede all prior discussions, understandings, representations, or agreements relating to the subscribed services, except where otherwise required by applicable law.

  1. Assignment

The Customer may not assign, transfer, or delegate any rights or obligations under these Terms without Blinkcook’s prior written consent.

Blinkcook may assign or transfer its rights and obligations under these Terms to an affiliate, successor, or purchaser of its business, provided such assignment does not materially reduce the Customer’s rights under applicable law.

  1. Interpretation

These Terms shall be interpreted as a whole and not by reference to any individual clause in isolation.

Where multiple provisions apply to a particular situation, they shall be read together with:

  • the Refund Policy;
  • the Privacy Policy;
  • the subscribed service plan;
  • Operational Records; and
  • other applicable Blinkcook policies.

Section headings are included solely for convenience and shall not affect the interpretation of these Terms.

Words importing the singular include the plural and vice versa where the context so requires.

References to one gender include all genders, unless the context clearly requires otherwise.

Nothing contained in these Terms shall be interpreted as creating:

  • an employment relationship between Blinkcook and any Candidate;
  • a partnership;
  • a joint venture;
  • an agency relationship; or
  • a fiduciary relationship between Blinkcook and the Customer.
